General Terms and Conditions of Sale

Article 1 – Purpose

These General Terms and Conditions of Sale (hereinafter "GTC") govern all contractual relationships between Cosmelia Beauty and any consumer customer making a purchase on the website https://cosmeliabeauty75.com. Any order implies full and complete acceptance of these GTC.

The seller carries out its activity in compliance with French legislation applicable to e-commerce.

Article 3 – Products

The products offered for sale are beauty and cosmetic items. The essential characteristics of each product (composition, use, dimensions) are listed on the product page. The photographs illustrate the products but cannot guarantee an absolute similarity with the product offered.

Article 4 – Prices

Prices are indicated in euros, all taxes included (TTC), excluding shipping costs. Shipping costs are specified before the order is confirmed. The seller reserves the right to change its prices at any time; products are charged at the rate in effect at the time of the order.

Article 5 – Order

The customer selects their products, fills out the order form, and confirms the payment. The sale is only final after the seller has received payment and confirmed the order by email. The seller reserves the right to refuse any order that appears unusual or fraudulent.

Article 6 – Payment

Payment is made online by credit card or other methods offered at checkout. Payment data is processed securely and encrypted; it is never stored by the seller.

Article 7 – Delivery

Orders are prepared and shipped within 1 to 3 business days. The estimated delivery time is 7 to 15 business days in metropolitan France. The risk of loss or damage is transferred to the customer upon delivery. In the event of an abnormally late delivery, the customer may cancel the order and receive a refund in accordance with Article L216-4 of the French Consumer Code.

Article 8 – Right of Withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has 14 days from receipt of the product to exercise their right of withdrawal, without having to justify their decision. Products must be returned in a condition that allows them to be resold. Return shipping costs are borne by the customer, except for defective or non-compliant items. To exercise this right, the customer may notify their decision to contact@cosmeliabeauty75.com, stating their order number.

Article 9 – 30-Day Satisfaction Guarantee

In addition to the legal right of withdrawal, Cosmelia Beauty offers a 30-day satisfaction guarantee: if the product does not suit you, contact us within 30 days of receipt to receive a refund. This commercial guarantee does not affect legal guarantees.

Article 10 – Legal Guarantees

All products benefit from the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

Article 11 – Liability

The seller cannot be held responsible for damages resulting from improper use of the products. It is reminded that cosmetic products must be used according to the instructions on their packaging; in the event of a skin reaction, it is recommended to consult a healthcare professional.

Article 12 – Personal Data

The data collected during orders is necessary for processing and delivering the orders. It is processed in accordance with our Privacy Policy and GDPR regulations. The customer has the right to access, rectify, and delete their data by writing to contact@cosmeliabeauty75.com.

Article 13 – Applicable Law and Disputes

These GTC are subject to French law. In the event of a dispute, the customer may free of charge refer the matter to a consumer mediator. Failing an amicable agreement, French courts shall have jurisdiction.
